Terms & Conditions + Liability Waiver

By booking, receiving, or using rental equipment, you agree to these Terms & Conditions, including the Release, Hold Harmless, and Assumption of Risk provisions below.

1) Definitions

Equipment includes bicycles, e-bikes (if offered), trailers, child seats, helmets, locks, baskets, and any accessories. Rental Period means the time from delivery/pickup to return/recovery. Renter is the person who books and pays and is responsible for all riders and Equipment.

2) Booking, Payment, and Identification

  • You authorize the Company to charge the payment method on file for rental fees and any additional charges permitted by this Agreement.
  • You may be required to present a valid ID and/or sign electronically at delivery/pickup.
  • Discounts/coupons are applied only as stated and may not be combined unless explicitly allowed.

3) Delivery & Pickup Terms

  • You must provide an accurate delivery address and access instructions (gate codes, unit number, etc.).
  • Equipment may be left at the designated location you specify if you authorize contactless delivery.

4) Rider Requirements & Safety

  • You agree all riders are capable of safely operating the Equipment.
  • Helmet use: Strongly recommended for all riders; required for minors where applicable by law. [CONFIRM local requirement]
  • No riding under the influence of alcohol/drugs.
  • Obey all traffic laws; ride defensively; use lights/reflectors when visibility is reduced.
  • Do not carry passengers unless the Equipment is specifically designed for it (e.g., child seat/trailer).

5) Prohibited Uses

  • Off-road riding, beach/surf riding, jumping/“stunt” riding, racing, or any use that is not ordinary recreational riding.
  • Towing anything other than Company-approved trailers.
  • Subleasing, transferring, or allowing use by anyone not approved by the Renter.
  • Leaving Equipment unsecured in public areas.

6) Condition of Equipment & Maintenance

  • Inspect Equipment at delivery/pickup. Notify us immediately of issues before riding.
  • You agree to keep Equipment in reasonable condition and use it only as intended.
  • Do not attempt major repairs; contact us for service instructions.

7) Damage, Loss, and Theft

You are responsible for loss, theft, or damage to Equipment during the Rental Period, including damage caused by misuse, neglect, saltwater exposure, or improper locking/storage.

  • Theft: Report to local law enforcement and to the Company immediately and provide a police report number.
  • Locks: Use provided locks as instructed; failure to properly secure Equipment may increase your liability.
  • Company may charge the payment method on file for repair/replacement, parts, labor, cleaning, recovery, and associated costs to restore Equipment. [CONFIRM cap/limits if any]

8) Late Returns & Additional Charges

Weather and road conditions can change quickly. You are responsible for deciding whether it is safe to ride. We may delay, modify, or cancel delivery/pickup due to unsafe conditions, access restrictions, or operational constraints.

10) Assumption of Risk

You understand that bicycling involves inherent risks including, without limitation, falls, collisions, road hazards, mechanical failure, weather, traffic, and actions of other riders/drivers. These risks may result in serious injury, paralysis, or death. You voluntarily assume all such risks for yourself and any minor(s) for whom you are responsible.

11) Release of Liability

To the fullest extent permitted by law, you (for yourself and on behalf of your heirs, assigns, and personal representatives) release and discharge the Company, its owners, employees, contractors, agents, and affiliates from any and all claims, demands, causes of action, damages, losses, or liabilities arising from or related to the rental, delivery, pickup, possession, use, or operation of the Equipment, including claims based on negligence, except to the extent prohibited by applicable law.

12) Hold Harmless Agreement

To the fullest extent permitted by law, you agree to hold harmless the Company, its owners, employees, contractors, agents, and affiliates from and against any and all claims, demands, actions, causes of action, damages, losses, liabilities, judgments, penalties, fines, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your or any rider’s use, misuse, possession, delivery, pickup, or operation of the Equipment; (b) your breach of this Agreement; (c) your violation of any law or rule; or (d) your acts or omissions, including negligence, except to the extent prohibited by applicable law.

13) Indemnification

You agree to defend, indemnify, and hold harmless the Company from any claims, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of your or any rider’s use/misuse of the Equipment, violation of this Agreement, or breach of any representation made by you, except to the extent prohibited by applicable law.

14) Medical Responsibility

You are responsible for any medical costs. You represent that you and all riders are physically able to ride and have no condition that would make riding unsafe.

15) Minors

If a rider is under 18, the Renter confirms they are the parent/legal guardian or have permission of the parent/legal guardian and accepts full responsibility for the minor’s supervision, safety, and compliance with this Agreement. The Renter agrees the waiver applies to the minor to the fullest extent permitted by law.

16) Privacy

17) Disputes, Governing Law, and Venue
